Shafi'i, may God be merciful to him, said: If he says, “Every woman that I marry is divorced” or [if he names] a specific woman or, [says] to

a [male] slave, “If I own you [you are] free,” and he marries [a woman] or owns [a slave], nothing is compulsory for him. [That is] because when he made the relevant statement, he was not an owner (malik), so it is void. Al-Muzani, may God be merciful to him, said: If he says to a woman whom he does not own (la yamlikuha), “You are divorced now,” she is not divorced. . . . Al-Muzani, may God be merciful to him, said: there is consensus that there is no path (sabil) to divorce for the one who does not own (yamliku).20
